RESIDENCE VISA FOR FAMILY REUNIFICATION FOR DEPENDANTS OF EUROPEAN UNION NATIONALS. 

Family members within the meaning of European law are, irrespective of nationality, the spouse and descendants of these persons dependent on them, as well as the dependent relatives in the ascending line of the person and their spouse.

European legislation gives spouses and children or parents who are dependent on European nationals exercising an employed or self-employed activity on the territory of a European member state the right to have access to an employed activity.

Under current European legislation, dependants of EU nationals already living in Spain or those wishing to take up residency with their EU spouses, who are themselves holders of passports of any other state outside the EU, may now apply for a residence permit in Spain, without applying for a visa prior to their departure.

Those nationals, holders of passports who require an entry visa to enter Spain, should apply for a visa to allow them to join their EU spouse. The visa must be applied for in person at the Consulate by previous appointment.

CONDITIONS OF APPLICATION FOR DEPENDENTS OF SPANISH NATIONALS:

  1. Four visa application forms fully completed and signed by the applicant at the bottom of the page.
  2. Four recent passport size photographs.
  3. Passport with a minimum validity of 120 days and photocopy of the whole passport, minus blank pages.
  4. Passport of the Spanish national or Spanish National Identity Card (spouse, father, mother, etc.) and photocopy of the relevant pages.
  5. It is important to note that a Spanish National must have an original Libro de Familia (Family Book) or a Spanish Marriage Certificate as proof of marriage, as otherwise the marriage is not recognised in Spain.
    A Birth Certificate in the case of ascendants and descendants duly legalised according to the Hague Convention, and proof that the ascendant or descendant is a family dependant.

Photocopies of all documents must be supplied.

Please note that a Police Certificate or “Certificado de penales”, stating that the applicant does not a have a criminal record might be exceptionally requested under certain circumstances either by the Consulate or the Spanish Police upon arrival in Spain.

Applications for visas will be accepted only BY PREVIOUS APPOINTMENT. Please DO NOT BUY your travel tickets.

CONDITIONS OF APPLICATION FOR DEPENDANTS OF OTHER EUROPEAN UNION NATIONALS:

  1. Four visa application forms fully completed and signed by the applicant at the bottom of the page.
  2. Four recent passport size photographs.
  3. Passport with a minimum validity of 120 days and photocopy of the whole passport, minus the blank pages.
  4. Passport of the European national moving or living in Spain and photocopy of the pages with the relevant information.
  5. Original Marriage Certificate, or Birth Certificate in the case of ascendants and descendants.
    In cases where documents are not from the EU the Hague Convention Apostille will be required together with a translation of the documents, proving that the ascendant or descendant is a family dependant.
    Photocopies will be required of all the documents.
  6. The EU national should have financially maintained the dependant relative for up to one year prior to the application.

Please note that a Police Certificate or “Certificado de penales”, stating that the applicant does not a have a criminal record might be exceptionally requested under certain circumstances either by the Consulate or the Spanish Police upon arrival in Spain.

A copy of the application form together with all the original documents will be certified by this Consulate General and returned to the applicant.

These documents will be necessary when applying for family reunification in Spain.

The visa will be issued will be given free of charge and will enable the holder to apply for Family Reunification in Spain.

Please note that holders of this visa when in transit to Spain are still subject to immigration control at the point of entry by any other Schengen member country.
