Rights, liberties, and social integration of foreigners in Spain


The standards which govern the rights, liberties, and social integration of foreigners in Spain are found in Organic Law 4/2000, dated January 11, as amended by Organic Law 8/2000, dated December 22, by Organic Law 11/2003, dated September 29, and by Organic Law 14/2003, dated November 20.

By means of Royal Decree 2393/2004, dated December 30, approval was given to the regulations implementing the Organic Law mentioned in the previous paragraph.

For citizens of the European Union, Norway, Iceland, Liechtenstein and Switzerland, as well as their spouses, ancestors, and descendents, applicable regulations are found in Royal Decree 240/2007, dated February 16, governing the entry and residency in Spain of citizens of the member states of the European Union and of other states that are party to the European Economic Space Agreement.

Entry requirements


Foreigners who wish to enter Spain with the intention of passing through or remaining for a period of less than ninety days per six-month period must meet the following conditions:

• Possess a valid travel document allowing him or her to cross borders.

• Possess a visa when required.

• Show documents justifying the purpose and conditions of the planned stay and have sufficient means to support themselves, both during the period of their planned stay and for their return to their country of origin or passage to a third State where their admittance is guaranteed, or they must be in conditions such that they can legally obtain such means.

• Not be banned from entering into Spain or any other country in the Schengen Space.

• Not represent a threat to Spain's public order, national security, or international relations, or to those of any other member country of the Schengen Space.
